If it is a public contract then the contracting authority is subject to the fundamental principles of public procurement (equal treatment, freedom of access and transparency of procedures)

If it is a private market then there is in my humble opinion no restriction as to the methods and formats or product references to be used or returned.

to put it into perspective, here is an operator's point of view:

the ideal is a BIM DOE, with the well-informed and up-to-date BIM model, TQC,

otherwise, it is better to receive an up-to-date digital DOE than an outdated BIM model,

otherwise, it is better to have an up-to-date paper DOE than an outdated digital DOE,

otherwise, it is better to have an EXE file than an outdated DOE, because at least we know that it is not a DOE.
